by the way my PM to Curm has been resting in my outbox for ages and the one to swift has been sent by the look...is that normal?

These things happen and are unfortunate. I'd make a point about thinking such a death being "due to PC/connection glitch", as opposed to "fair and game", though. We play a computer game and we're not entitled to having perfect response all the time. This should be factored in as part of the nature of the game, and what is fair and game. A lag spike is as possible a factor making your PC's game harder as is the enemy rolling two 20s in a row and max damage. There are numerous occasions where the fact that this is a computer game that makes our game lots easier too, like stuff due to your opponent being run by AI as opposed to a human.
One can also ask oneself would it really made a difference if there was no lag, given the same combat rolls otherwise? If the kobold hit you two times in a row, if you had the chance to react to the first, what could you have done to lead to different outcome? For example, if you try to drink potion or run away -> AoO, and the second hit lands and kills you. (And kobolds maybe carrying x3 crit weapons...)
But at the end fo the day, finding in retrospect something your PC conceivably could have done doesn't make that much a difference: It's not a given that's what he would have done if the controls hadn't been momentarily suspended. The fact that it's a real-time game and you can't presume to have perfect control to execute optimal tactics all the time is just a natural part of the game we play. And for one, the AI falling way shorter of the optimal tactics more than compensates for it.
I'm not DMing on TSM or otherwise involved in arbitration of the case. But that's a couple of my cents on the general gaming attitude. So no, I'd say "death due to lag" is not a thing. It's just death due to being killed that happens.

on that note I think Ill just live with the fact my guy is dead like everyone else does. I will be the first to admit (and after some thought) that after everything is said and done, lag or no, I shouldnt have thought to enter the damn cave given I was alone. So I guess lag death or not...probably what killed me was a lack of caution...At the very least if you have lag at all probably stay away from something that can kill you.
I appreciate the advice and honesty. Time to roll up another PC...liked the idea of ranger druid so may make another one....maybe higher wisdom or something
On a side note, I read somewhere that back in 2009 permadeath was taken out and a respawn system was put in? was than alfa nwn1 or have i completly got my wires crossed?

Rezzes are possible, but I can't recall there ever being a respawn system.
Back in NWN1 ALFA there were NPC clerics in most of the big cities who could cast Raise Dead if you had enough gold. *chuckles* They'd also loot your friend's corpse the minute you put it on the ground.

We have had suggestions and proposals to formally remove permadeath from our systems in various situations (usually, it's "I dislike PvE permadeath, but we should totally keep PvP permadeath"), but none have been implemented or even gained much traction. Though you might have heard people cynically complaining that ALFA has no permadeath (verifiably false; people die, and most people who die stay dead) and/or only has permadeath for some people (which is true-- you generally have to take potentially-lethal risks to die, and not everyone takes those risks or takes them frequently enough for the odds to hit them), which might be the source of what you're hearing.

FWIW, I consider lag-deaths tech-deaths and often offer a restating of the scenario.

In order to check on your PC's fate, your HDM needs to know BOTH your PC's name, and the name you log into NWN2 with, often known as your GSID (GameSpy ID), otherwise we are left sadly scratching our heads saying, "Now who was that again?"
Please include this very important information in your message when you write asking for a Tech Rezz.
Also, screen shots of your Server Chat window showing the server's messages during your unfortunate demise are also most helpful in judging your case.
