Yes, they are. You may only have them for educational purposes, i.e. a schoolteacher in a history class.

Again, that's part of the concept of the "wehrhafte Demokratie" - just because a Swastika in itself does no harm, does not mean we need to allow the promotion of a symbol that is inseperably tied to unconstitutional and criminal ideas.
